Prosecutors face hurdles in Trayvon Martin case

SANFORD, Fla. (AP) ? After an extraordinary public campaign to make an arrest in the shooting of an unarmed black teen, a Florida prosecutor came back with a murder charge in the case that has galvanized the nation for weeks.

But prosecutors face steep hurdles to win a second-degree murder conviction against neighborhood watch volunteer George Zimmerman in the killing of Trayvon Martin, experts say. They will have to prove Zimmerman intentionally went after Martin instead of shooting him in self-defense, refute arguments that a Florida law empowered him to use deadly force and get past a judge's ruling at a pretrial hearing.

Zimmerman, 28, who turned himself in at a county jail Wednesday after prosecutor Angela Corey announced the charge, was to appear before a magistrate Thursday and plead not guilty in the Feb. 26 shooting of the 17-year-old that set off a nationwide debate about racial profiling and the rights to self-defense.

"He is concerned about getting a fair trial and a fair presentation," his attorney, Mark O'Mara said. "He is a client who has a lot of hatred focused on him. I'm hoping the hatred settles down ... he has the right to his own safety and the case being tried before a judge and jury."

Legal experts said Corey chose a tough route with the murder charge, which could send Zimmerman to prison for life if he's convicted, over manslaughter, which usually carries 15-year prison terms and covers reckless or negligent killings.

The prosecutors must prove Zimmerman's shooting of Martin was rooted in hatred or ill will and counter his claims that he shot Martin to protect himself while patrolling his gated community in the Orlando suburb of Sanford. Zimmerman's lawyers would only have to prove by a preponderance of evidence ? a relatively low legal standard ? that he acted in self-defense at a pretrial hearing to prevent the case from going to trial.

There's a "high likelihood it could be dismissed by the judge even before the jury gets to hear the case," Florida defense attorney Richard Hornsby said.

Corey announced the charges Wednesday after an extraordinary 45-day campaign for Zimmerman's arrest, led by Martin's parents and civil rights activists, including the Rev. Al Sharpton and the Rev. Jesse Jackson. Protesters wore hooded sweatshirts like the one Martin had on the night of the shooting. The debate reached all the way to the White House, where President Barack Obama observed last month: "If I had a son, he'd look like Trayvon."

Corey would not discuss how she reconciled conflicting accounts of the shooting by Zimmerman, witnesses and phone recordings that indicated Martin thought Zimmerman was following him.

"We do not prosecute by public pressure or by petition. We prosecute based on the facts on any given case as well as the laws of the state of Florida," Corey said.

Martin's parents expressed relief over the decision to prosecute the person who shot their son.

"The question I would really like to ask him is, if he could look into Trayvon's eyes and see how innocent he was, would he have then pulled the trigger? Or would he have just let him go on home?" said his father, Tracy Martin.

Many attorneys said they had expected the prosecutor to opt for the lesser charge of manslaughter. The most severe homicide charge, first-degree murder, is subject to the death penalty in Florida and requires premeditation ? something all sides agreed was not present in this case.

"I predicted manslaughter, so I'm a little surprised," said Michael Seigel, a former federal prosecutor who now teaches law at the University of Florida. "But she has more facts than I do."

O'Mara, Zimmerman's attorney, said his client would plead not guilty and invoke Florida's so-called "stand your ground" law, which gives people wide latitude to use deadly force rather than retreat during a fight.

The confrontation took place in a gated community where Martin was staying with his father and his father's fianc?e. Martin was walking back in the rain from a convenience store when Zimmerman spotted him and called 911. He followed the teenager despite being told not to by a police dispatcher and the two got into a struggle.

Zimmerman told police Martin punched him in the nose, knocking him down, and then began banging the volunteer's head on the sidewalk. Zimmerman said he shot Martin in fear for his life. Sanford police took Zimmerman, whose father is white and whose mother is Hispanic, into custody the night of the shooting but released him without charging him.

A judge could dismiss the charge based on the "stand your ground" law, legal experts said. But some experts say the judge will also be under tremendous pressure to let the case go forward.

"Judges are not likely to take that out of the hands of the jury," said Florida defense attorney Randy Reep.

Other attorneys weren't surprised that Corey went for the maximum.

"Prosecutors look for leverage. They'll typically overcharge knowing that gives them wiggle room for plea discussions," said Derek Byrd, incoming president of the Florida Association of Criminal Defense Lawyers. "She knows that she could offer him manslaughter at some point or get in front of a jury that could split the verdict and agree on a lesser offense."

Corey wouldn't discuss how she arrived at the charges or disclose other details of her investigation. The prosecutor in Jacksonville was appointed to handle the case by Republican Gov. Rick Scott after the local prosecutor disqualified himself.

The U.S. Justice Department's civil rights division is conducting its own civil rights investigation.

Tensions had risen in Sanford, a town of 50,000 outside Orlando. Someone shot up an unoccupied police car Tuesday outside the neighborhood where Martin was killed. Outside of Sanford City Hall on Wednesday, Stacy Davis, who is black, said the arrest "is not a black or white thing for me. It's a right or wrong thing."

In Washington, Martin's family pleaded for calm in response to the decision. But Martin's mother, Sybrina Fulton, clasped hands and smiled in relief when she heard Corey utter the words "second-degree murder" on television.

"We wanted an arrest and we got it," Fulton said later. "Thank you Lord, Thank you, Jesus."

Dr. Lester Breslow dies at 97; UCLA dean was 'Mr. Public Health'

Dr. Lester Breslow, the UCLA researcher who became known as "Mr. Public Health" because of his research emphasizing the beneficial effects of avoiding certain behaviors, such as smoking, overeating and failing to exercise regularly, has died. He was 97.

Breslow, a former director of the California Department of Public Health and dean of UCLA's Fielding School of Public Health, died Monday at his home in Los Angeles, the university announced.

Breslow played a key role in medicine's transition from an emphasis on simply treating disease to a much broader effort to prevent it. Medicine focused "almost exclusively on communicable diseases when I started" in the 1940s, he recently recalled. "I felt public health needed a broader vision."

He really was "a legend" because his influence "has persisted for such a long time ? seven decades," said Dr. Linda Rosenstock, the current dean of the school. "In terms of understanding the ability to prevent chronic disease through exercise, diet and [not] smoking, he is the single human being that is given the most credit."

Most physicians today would recognize that it is just as important to prevent disease, particularly diabetes, heart conditions and other chronic illnesses, as it is to treat them. But when Breslow began his work, his concerns were met with skepticism and outright disdain.

In his initial interview to join the California public health department, he was told, he said, "to take his crazy ideas back to Minnesota and try them there."

Only the intervention of a friend brought him into the agency. And it was there that he carried out what he and others consider his greatest accomplishment, the Alameda County Human Population Laboratory.

Beginning in 1959, Breslow and his colleagues enrolled about 7,000 residents of the county in a study to determine whether and how well they adhered to what he identified as seven habits of healthy living. Six of the habits had been identified by previous research: exercising regularly; getting regular sleep; not smoking; drinking moderately or not at all; eating regular meals and not snacking in between; and maintaining a normal weight.

The seventh, eating a regular breakfast, was simply an educated guess, he admitted later.

The results were dramatic. The team reported in the early 1970s that a 45-year-old who adhered to at least six of the seven habits had a life expectancy 11 years longer than that of peers who followed fewer than four. A 60-year-old who followed all seven of the habits was as healthy as a 30-year-old who followed two or less.

"I'd never seen such a systematic, positive, strong finding," Breslow said. "The results were so astonishing that I didn't believe it" at first. "I thought my colleagues were playing a joke on me."

Even among those who did not die, the effects of neglecting good health could be devastating. In a 1993 study co-authored with his son Norman, a statistician at the University of Washington, he reported that those who had six or seven of the poor health habits in 1965 were twice as likely as their neighbors with no more than two of the bad habits to be disabled 10 years later.

Among participants with one or no poor habits, the researchers found 12.2% were disabled 10 years later. Among those with two or three poor health habits, 14.1% were disabled, while 18.7% of those with four or more were disabled.

As a youth in North Dakota, Breslow had tried smoking corn silk in corncob pipes and had even experimented with cigarettes, but found that they irritated his throat. He later concluded that smoking was a major health risk and initiated several studies while he was head of the public health department. Three of those studies linking smoking to lung cancer and other diseases were cited in the U.S. surgeon general's landmark 1964 report on smoking.

Lester Breslow was born March 17, 1915, in Bismarck, N.D., the son of a pharmacist. He developed a severe stammer, but a friendly nurse encouraged him to read aloud and conduct other exercises to improve his speech. By high school, he was able to join the debate team and develop a speaking ability that served him well most of his life.

He received a bachelor's degree in psychology from the University of Minnesota in 1935 and his medical degree in 1938. But his experiences in a mental hospital in Rochester, Minn., soured him on the profession and he turned his interests to public health, receiving a master's in 1941.

In 1943, he volunteered for the U.S. Army Medical Corps and received training in tropical diseases. Posted in San Francisco, he was responsible for ensuring that no communicable diseases were brought into the city by returning military personnel. He later transferred to the Army's 7th Infantry Division in the Philippines, where he identified an epidemic of the parasitic disease schistosomiasis, and then to Okinawa.

In 1946, he joined the California public health department, becoming chief of the bureau of chronic diseases and, ultimately, head of the department.

He was active in the creation of the state's Medi-Cal program, promoted screening for the genetic disorder phenylketonuria among newborns and campaigned against smog, measles and unnecessary noise.

Breslow also started the state's Tumor Registry, which has been instrumental in hundreds of studies of environmental and behavioral effects on cancer.

In 1968, he left state service to join UCLA, where he remained for the rest of his career. He served as dean of the School of Public Health from 1972 to 1980.

In 1952, he served as director of President Truman's Commission on Health Needs of the Nation and subsequently served on a variety of other commissions and advisory boards. A past president of the American Public Health Assn., he also established and was the first editor of the Encyclopedia of Public Health.

Breslow followed his own prescriptions, walking regularly and practicing moderation in all his activities. He cleared rocks from the hillside above his Bel-Air home to create a fruit and vegetable garden that he tended regularly, keeping precise records of all that he harvested.

He married the former Alice Philp in 1939 and they had three sons before divorcing. In 1967, he married Devra Miller.

He is survived by his wife; sons Norman, Jack and Stephen; three grandchildren; and four great-grandchildren.

Now that Google+ is speeding toward the 200 million user mark, it's rolling out a revamped design that includes a new way to navigate the stream, "conversation cards," and a dedicated Hangouts page.

I checked mine today and I've still got the same old same old, but here's what I and other plussers have to look forward to within a few days, according to the blog post by Google senior vice-president Vic Gundotra:

A "dynamic ribbon of applications on the left" that replaces the "static icons" normally positioned at the upper left, next to the search bar. This new configuration is designed to allow?access to most used or favorite apps faster, and to make it easier to make adjustments as your needs change and/or evolve. The gist of it is you can drag apps in whatever order you want and hover over some "to reveal a set of quick actions." If any annoy you, you can hide them or move them into the "More" category.

G+ also wants to make it easier for its users to scan/join discussions, and you'll soon see "a stream of conversation 'cards'" that are supposed to make this easier. What it looks like is a streamlined feed that will only show you the latest comment under a post, rather than the couple that you see now.

Also in your G+ future: "An activity drawer that highlights the community around your content."

The one thing I think really stands out in G+ are the photos and videos, and the redesign promises "full bleed" images and even bigger and better things with those visual elements. "Simply put, we're hoping to make sharing more awesome by making it more evocative," writes?Gundotra.?"You know that feeling you get when a piece of art takes your breath away, or when a friend stops by with unexpected gifts? We want sharing to feel like that, every single time."

Every. Single. Time.

High bar to set, but this is one area whereG+ really shines.?

People who are into Hangouts will probably like that now there's a dedicated page just for that activity. From here, you'll be able to tap any of your friends for impromptu "Hey girl, what's up!" video chats because you'll have a constantly updated list of invites from your buddies. You can also play your own version of Chatroulette and join public and On Air chats more easily, or just watch, if you prefer.

If you find G+ at times a bit overwhelming and hard to wade through, a new Explore page might be the life preserver you need, as it "shows what's interesting and trending across the network."

There are definitely hints of Facebook's latest changes among the new additions, including "a new profile with much bigger photos" that looks a lot like the banner cover photos over on Timeline, as well as "a new chat list that puts your friends front and center" that should look familiar to those who use Facebook chat.

Facebook users who hate Timeline (and we know, there are plenty of you out there) might appreciate the relative simplicity of the G+ profile, which has a lot less clutter than the current Facebook profile.

Mickey Loomis, a six-game suspension for assistant head coach/linebackers coach Joe Vitt, an indefinite suspension for former Saints defensive coordinator Gregg Williams, and a $500,000 fine and the loss of two second-round pick for the Saints.? (All suspensions have been upheld on appeal; Williams did not file an appeal.)

There?s a chance Brees is splitting hairs.? After all, the only player carted off during a Saints game from 2009 through 2011 was former Saints running back Reggie Bush, who broke a leg during a 2010 Monday night game against the 49ers.? So while there may have been a financial incentive for Saints defensive players to cause ?cart-offs,? no one ever succeeded.

Brees also addressed the fact that defensive players are aggressive.? ?When a guy has an opportunity to take a shot at the quarterback, he?s going to take it,? Brees comments come at a time when some league insiders contend that Brees knew about the bounty system, that he confronted his teammates about it, and that he was told that other teams have bounties on him.? (In a poll posted last month at PFT, nearly 80 percent of more than 15,000 who responded believe that Brees knew about the bounty system.)

Though it?s not known, and possibly won?t be known, whether Brees knew about the situation and whether he did anything to try to stop it, the NFL has concluded that a bounty system was in pace, the NFL has meted out punishment against the coaches involved, and the NFL is now poised to punish the players.? Given that it wasn?t in the league?s broader interests to expose a bounty system if in fact there was no bounty system, it?s hard to agree with Brees? claim that the league?s allegations are incorrect.

The Korea Advanced Institute of Science and Technology (KAIST) announced that a research team from the Department of Materials Science and Engineering has developed a technology that enables scientists and engineers to observe processes occurring in liquid media on the smallest possible scale which is less than a nanometer.

Professor Jeong Yong Lee and Researcher Jong Min Yuk, in collaboration with Professor Paul Alivisatos's and Professor Alex Zettl's groups at the University of California, Berkeley, succeeded in making a graphene liquid cell or capsule, confining an ultra-thin liquid film between layers of graphene, for real-time and in situ imagining of nanoscale processes in fluids with atomic-level resolution by a transmission electron microscope (TEM). Their research was published in the April 6, 2012 issue of Science. (http://www.sciencemag.org/content/336/6077/61.abstract)

The graphene liquid cell (GLC) is composed of two sheets of graphene sandwiched to create a sealed chamber where a platinum growth solution is encapsulated in the form of a thin slice. Each graphene layer has a thickness of one carbon atom, the thinnest membrane that has ever been used to fabricate a liquid cell required for TEM.

The research team peered inside the GLC to observe the growth and dynamics of platinum nanocrystals in solution as they coalesced into a larger size, during which the graphene membrane with the encapsulated liquid remained intact. The researchers from KAIST and the UC Berkeley identified important features in the ongoing process of the nanocrystals' coalescence and their expansion through coalescence to form certain shapes by imaging the phenomena with atomic-level resolution.

Professor Lee said,

"It has now become possible for scientists to observe what is happening in liquids on an atomic level under transmission electron microscopes."

Researcher Yuk, one of the first authors of the paper, explained his research work.

"This research will promote other fields of study related to materials in a fluid stage including physical, chemical, and biological phenomena at the atomic level and promises numerous applications in the future. Pending further studies on liquid microscopy, the full application of a graphene-liquid-cell (GLC) TEM to biological samples is yet to be confirmed. Nonetheless, the GLC is the most effective technique developed today to sustain the natural state of fluid samples or species suspended in the liquid for a TEM imaging."

The transmission electron microscope (TEM), first introduced in the 1930s, produces images at a significantly higher resolution than light microscopes, allowing users to examine the smallest level of physical, chemical, and biological phenomena. Observations by TEM with atomic resolution, however, have been limited to solid and/or frozen samples, and thus it has previously been impossible to study the real time fluid dynamics of liquid phases.

TEM imaging is performed in a high vacuum chamber in which a thin slice of the imaged sample is situated, and an electron beam passes through the slice to create an image. In this process, a liquid medium, unlike solid or frozen samples, evaporates, making it difficult to observe under TEM.

Attempts to produce a liquid capsule have thus far been made with electron-transparent membranes of such materials as silicon nitride or silicon oxide; such liquid capsules are relatively thick (tens to one hundred nanometers), however, resulting in poor electron transmittance with a reduced resolution of only a few nanometers. Silicon nitride is 25 nanometers thick, whereas graphene is only 0.34 nanometers.

Graphene, most commonly found in bulk graphite, is the thinnest material made out of carbon atoms. It has unique properties such as mechanical tensile strength, high flexibility, impermeability to small molecules, and high electrical conductivity. Graphene is an excellent material to hold micro- and nanoscopic objects for observation in a transmission electron microscope by minimizing scattering of the electron beam that irradiates a liquid sample while reducing charging and heating effects.

First Dedicated Biorefinery Could Wean Hawaii Off Imported Oil

On former pineapple fields outside of Honolulu, an industrial tube has been erected, ensconced in a steel scaffold. Dwarfed by the nearby oil refinery, the modest tube represents an attempt to one day wean Hawaii from imported oil. It is the nation's first dedicated biorefinery, employing high heat to turn plant matter into oil, followed by chemical catalysis to upgrade that oil into a useable fuel, just like the much larger refinery down the road.

The biorefinery "makes a fuel which is usable in generator sets, boilers and also possibly in marine engines," says chemical engineer Jim Rekoske, vice president of renewable energy and chemicals at Honeywell's UOP, the company responsible for building and operating the facility. By next year, UOP hopes to have the full biorefinery in place, which will be able to make almost any transportation fuel.

As the company has demonstrated elsewhere in the world, it is possible to make jet fuel from plant oils?whether they come from jatropha seeds, the flowering weed camelina or any other oil-producing plant. The same is true for other forms of transportation fuel, whether corn ethanol for cars or algal oil to power ships. The new facility in Hawaii will be the first integrated biorefinery dedicated to churning out bio-based versions of the full range of fuels more commonly made from petroleum.

Island state
Hawaii relies almost entirely on oil for its energy, whether it be gasoline for its cars, jet fuel for the planes that shuttle tourists in and out or even heavier oil to burn in its power plants. All of that oil comes in by supertanker, and even the island's most defensive inhabitant?the U.S. military?is nearly completely reliant on shipped-in fuel. All told, the state imports 45 million barrels of oil a year, nearly a third of which goes to run power plants.

The new biorefinery is a first step to changing that. It will take in biomass?the generic term for the leaves, stems and other bits of plants not typically used for food for humans and livestock. That will include inedible components of Hawaiian crops, such as macadamia nuts and sugarcane, as well as guinea grass and eucalyptus. The oil-rich jatropha plant and other so-called "energy crops" being grown on the island may also pass through the industrial plant, as long as growers are willing to part with it for free (though that may prove unlikely). "We're going to use whatever we can get our hands on," Rekoske says, in a bid to demonstrate the flexibility of the technology.?

The biomass is ground into tiny bits and dried to drive out the water that can make up as much as half of the weight of fresh plant material. The plant flecks fly through the tube where ordinary sand heated to 500 degrees Celsius flashes them to an oil vapor in less than 800 milliseconds in a process called pyrolysis. What is left is the sand and the bits of biomass that cannot be vaporized, such as various salts and some residual char. The vapor exits and the solid bits drop to the bottom, where the char is burned to reheat the sand. "There is enough heat in the combustion of the char to heat the sand up to a high enough temperature to run the pyrolysis," Rekoske claims.

The oil vapor, meanwhile, is condensed into a liquid fuel, which is then further upgraded and processed to make a green fuel similar to the bunker fuel that is used in cargo ship engines and industrial boilers, for example, except it lacks the pollution-causing sulfur common to the bunker fuel refined from petroleum. Potential partners thus range from the U.S. Pacific Command (USPC), based in Honolulu, to local electricity cooperatives. And next year, when the full biorefinery is complete, UOP will be able to make everything from gasoline to jet fuel. "The idea is to make a whole barrel of product out of the biorefinery," Rekoske says.

A Petition To Stop Mark Driscoll From Speaking At Liberty University ?

First of all let me just say this is ridiculous. On the one hand you have that bastion of ignorance and fundamentalism, Liberty University, founded by one of the most bigoted idiotic men of the twentieth century, Jerry Falwell; and on the other, the cult like stylings and stupidity of Mark Driscoll. So there?s really no where to go but down.

Matthew Paul Turner was the first to blog on this?I think?noting that Driscoll, along with his wife Grace, were scheduled to perform their ?Real Marriage? skit at Liberty on April 20 and 21.

Driscoll is a big fan of sex, so long as it?s heterosexual married sex and the women folk remember to be responsive, submissive and don?t get any ideas above their God appointed station.

He?s a patriarch. Respect his authority and he?s fine. Reject his authority ? by, for example, having differing opinions ? and he?ll f?ck you up.

Yep? unfortunately that?s pretty much it.

But this story gets stranger. There is also a blogger who goes by the handle Sophia at Mars Hill Refuge, which is a blog for recovering members of Mars Hill who has started an online petition to keep Driscoll from LU.

So to raise curiosity about a problem (emotional and spiritual devastation coming out of Mars Hill church) that we have seen for years in our community and now spreading nationwide as Driscoll?s fame and Acts 29 church network grows, we need to spark curiosity about what is happening behind the scenes. If demand is created then news outlets will cover these devastating stories of people who were once on the inner circle of Mars Hill church. Since Driscoll is a national bestseller and getting lots of media attention we decided to petition Liberty University to rescind their invite for Driscoll to speak on their campus on April 20th. We think that would get the conservatives and fundamentalists engaged as well. Once the truth is brought to light then healing can begin, as any survivor will tell you.

So to ?raise curiosity? about the problems coming out of Mar?s Hill did Sophia highlight that Mark Driscoll is a bully? A demon-worshiper? Incredibly non-discerning? A terrible scholar and liar? A seriously disturbed and mentally ill delusional pervert?

Anyways, if this story is not already the most ridiculous thing you could read today?misogynistic Mark going Liberty U to teach on marriage, I mean, that just about makes my brain break at the lunacy?there is yet another wrinkle.

Another blogger, Peter Lumpkins attempted to stir the pot by ?reporting? that the board of trustees had decided Driscoll was not welcome

Sources say trustees took a vote, and the vote was unanimous indicating that Mark Driscoll is not welcome at Liberty University. In addition to Driscoll?s ?potty mouth? approach to pulpit etiquette playing a role in their decision, his ?Reformed? theology, Acts 29 Network, and the provocative hedonistic understanding of a___ s__ came up as well ? Trustees were apparently flabbergasted that Driscoll was considered for an invitation in the first place.

When someone can?t write the words ?anal sex? in a report I think we know what kind of mindset we?re dealing with. Furthermore, it appears that Lumpkins entire ?report? was anal excretions!

The Liberty University website is denying this claim:

On April 4, 2012, a Southern Baptist blogger, Peter Lumpkins, wrote an innacurate account of Liberty?s recent Board of Trustees meeting as it relates to the university?s invitation to Mark Driscoll to speak in Convocation. Lumpkin?s recent blog contains information that is defamatory and portrays Liberty University in a false light.

The Board of Trustees of Liberty University did not vote unanimously that Mark Driscoll is not welcome on campus, as the blog states, and, in fact, Mark Driscoll is still scheduled to speak in Convocation at Liberty University on April 20, 2012.

So there you have it, and like I said it could only go downhill? a veritable Rabbit?s hole of stupidity involving Driscoll, LU, Christian bloggers, and ridiculous petitions. Driscoll is not scheduled to be at LU until April 20th. My guess is that we will see some more shenanigans before that date comes.

Analysis: Q1 bank results face great expectations

(Reuters) - Bank executives face great expectations from investors when they report first-quarter results beginning Friday.

Bank stocks have shot up 24 percent this year, as measured by the KBW Banks index, in their steepest ascent in any quarter since the end of September 2009.

Now investors want to know if they should stick with their bets that the economy will strengthen and lift bank lending margins and profits, or take their gains and get out.

"Investors are out on a limb," said Jack Ablin, chief investment officer at Harris Private Bank.

They won't get much help from the earnings, which are expected to be murky this quarter and confused by accounting items. Investors may have to rely on their own hunches to sort conflicting numbers and comments from bank executives about the unfolding course of the economy.

Chris Bingaman, a portfolio manager at Diamond Hill Capital Management in Columbus, Ohio, is among the buyers. Bingaman, whose firm manages $9 billion, said he's been picking up shares of Wells Fargo & Co, JPMorgan Chase & Co, U.S. Bancorp and PNC Financial Services Group Inc lately. The prices, compared with expected future cash flows, are still attractive, he explained.

Still, Bingaman called the banks "revenue challenged" because bank customers remain reluctant to borrow and profit margins are being held down by low interest rates. "That puts a damper on revenue growth overall," Bingaman said.

At the least, Bingaman said, he wants to see the banks report that their lending margins have stopped contracting. Net interest margins at JPMorgan, for example, were down to 2.70 percentage points in the fourth quarter of 2011 from 2.88 points a year earlier and 3.33 points in 2009.

Even if the contraction were to stop, at least another three to six months must pass before lending margins actually increase, said Chris Kotowski, an analyst at Oppenheimer. "You need to see more loan growth," he said.

But Kotowski said that the current slow growth in loan portfolios is a big step from the shrinkage two years ago and points toward increasing momentum in borrowing and a stronger recovery in bank profits. "Slowly, but surely, people are going to realize that this is for real," Kotowski said.

In the meantime, sorting out what is real could be difficult. Some banks will likely report loan growth that stems not from new demand from customers for funds, but from taking business from competitors, said analyst Paul Miller of FBR Capital Markets & Co. "The overall economic growth needed for loan growth still is not there," Miller said. Loan balances at banks in recent weeks have been running about 4.0 percent higher than a year earlier, according to Federal Reserve data, but some of that increase is thought to have come at the expense of European banks and lenders in the capital markets.

JPMorgan and Wells Fargo kick off bank earnings Friday morning. For 81 financial companies in the S&P 500 stock index, first-quarter earnings are expected to be up 6.5 percent from a year ago, according to surveys of analysts by Thomson Reuters I/B/E/S through April 4. For the full year, analysts expect the earnings will be up 22.4 percent from 2011.

Underneath the averages are likely to be confusing cross-currents about whether the quarter was good or bad. For example, while profits are expected to be higher for banks in general, earnings per share will be down in the first quarter from a year earlier for JPMorgan and Citigroup Inc , according to surveys of analysts. But compared with the fourth quarter, profits for JPMorgan and Citigroup are expected to be higher. The big reason for the expected flip-flop in fortunes for the two banks: Their trading and investment banking business in the first quarter were worse than a year before but better then three months ago.

Profit from making new mortgages is expected to counterbalance the loss of fee income from new restrictions on how much banks can charge merchants for debit card transactions. Wells Fargo and JPMorgan have big mortgage operations and some regional banks, such as SunTrust Banks Inc and Fifth Third Bancorp could get a lift, too. Though most new mortgages are used now to refinance existing loans, they are generating additional revenue for the banks.

"We're going to see decent earnings for banks that embrace mortgage banking," said Miller of FBR Capital Markets & Co. "It's probably some of the most profitable stuff you can do."

With overall revenue weak, bankers know investors will be looking hard at their expenses. At Bank of America Corp, whose shares are up 66 percent this year, more than any other big bank, executives are expected to supplement their April 19 earnings report with details of the second phase of a campaign that has already set out to eliminate $5 billion in annual expenses and 30,000 jobs.

Analysts caution that there are at least two wild cards that could rock the results of the biggest banks: trading revenue and the impact of accounting adjustments, known as debt valuation adjustment or DVA, which must be made for changes in the value of debts the banks owe.

Bond trading increased as investors were more willing to take on risk in the quarter than they were at the end of the year. But profit margins for the dealers tightened. Overall, quarterly revenue from fixed income, currency and commodity trading at the investment banks was likely down more than 20 percent from a year earlier, but up more than 100 percent from three months earlier, analyst David Konrad of Keefe, Bruyette & Woods wrote in a report April 2.

Equity capital markets volumes and fees for advising completed takeovers were down about 25 percent in the quarter from a year earlier, according to Thomson Reuters data.

The accounting adjustments known as DVA perversely reduce the reported earnings of banks when their creditworthiness improves. Because analysts vary in how much work they do to factor DVA into their earnings estimates, the adjustments can create confusion about whether banks actually missed or beat Wall Street expectations.

Bank stock buyers may chose to ignore the accounting noise and the mixed signals. "The psychology seems to be getting better," said Frank Barkocy, director of research at Mendon Capital Advisors. "We're continuing to see signs of improvement in the US economy."
